Terms of sales

1. Definitions“Seller” refers to NSCB Aviation and its affiliated entities.“Buyer” refers to any individual, organization, or entity purchasing goods or services from NSCB Aviation.“Goods” includes engines, propellers, spares, consumables, tools, replacements, overhauled items, exchange units, and any aviation-related products supplied by the Seller.“Services” includes overhauls, inspections, repairs, training, installation, technical assistance, or consultancy performed by the Seller.

2. General Terms
All quotations issued by NSCB Aviation are valid for 7 days unless stated otherwise. Placement of a purchase order (PO) or written confirmation constitutes full acceptance of these Terms of Sales. No amendment, modification, or verbal agreement shall be valid unless confirmed in writing by an authorized representative of NSCB Aviation.

3. Pricing and Taxes
All prices are quoted Ex-Works (EXW) unless otherwise agreed.Taxes, duties, freight, insurance, customs charges, and government fees are the Buyer’s responsibility.Prices may vary based on OEM price changes, exchange rates, or availability without prior notice until a confirmed PO is acknowledged.

4. Payment Terms
Payments must be made as per the terms specified in the quotation or invoice. Default terms:50% advance with PO,50% before delivery or dispatch.Overhaul/repair services require full payment prior to release (Return to Service). Delayed payments attract interest @ 2% per month.Goods remain the property of NSCB Aviation until full payment is received.

5. Delivery & Lead Times
Delivery timelines are estimates only, subject to OEM supply, import clearances, and logistics conditions. NSCB Aviation is not liable for delays arising from OEM backlogs, customs delays, transportation issues, or force majeure.

6. Inspection & Acceptance
Buyer must inspect the goods immediately upon delivery. Any discrepancy, damage, or short-supply must be reported within 72 hours of receiving the goods. After 72 hours, NSCB Aviation will consider all deliveries as complete and accepted.

7. Returns, Claims & Rejections
Aviation goods are highly sensitive and regulated; therefore, returns are not accepted unless:Wrong item delivered,Factory/OEM defect confirmed,Part delivered is not as per PO specifications. All return requests must be raised within 7 days of receipt with supporting photographic or documentary proof. Goods must remain unused, uninstalled, and in original sealed packaging to qualify for return. Any claim made after 3 months of delivery will not be entertained under any circumstance.Installed or operated aviation components are strictly non-returnable.

8. Warranty
Warranty is provided only as per OEM terms, and NSCB Aviation does not provide any additional warranty. Warranty does not cover:Improper installation. Unauthorized handling. Wear and tear. Corrosion due to environment. Negligence or accidentWarranty claims are subject to OEM inspection and may require the Buyer to ship the part at their own cost.

9. Overhaul & Repair Services
All services are performed as per approved manuals and regulatory guidelines. Quoted overhaul estimates may change based on actual inspection findings. Scrap or additional mandatory replacement parts will be charged extra. Customer must approve additional work within 48 hours to avoid delays. NSCB Aviation is not responsible for:Pre-existing damageHidden defectsDamage discovered during teardown

10. Exchange Units
Exchange parts must be returned with matching configuration within 15 days. Late, incomplete, or damaged cores will result in additional charges based on OEM evaluation.

11. Limitation of Liability
NSCB Aviation’s maximum liability is limited to the value of the goods or services supplied. The Seller is not liable for:Loss of useDowntime costs flight delays. Indirect, incidental, or consequential damages. Financial losses or loss of revenueBuyer is responsible for ensuring the suitability of the goods for their intended use.

12. Regulatory Compliance
All parts supplied follow applicable aviation regulations (DGCA/CAA/EASA/FAA) subject to availability. Buyer must ensure installation is done by authorized personnel only.

13. Force Majeure
NSCB Aviation is not liable for any delay or failure due to circumstances beyond control, including:Natural disasters, War, terrorism, Pandemic, epidemic OEM production delays customs issues transport disruptions.

14. Termination of Order
Seller may cancel the order if:Buyer fails to make payment. Buyer provides false informationExport or regulatory restrictions applyOEM discontinues or restricts supply

15. Governing Law & Jurisdiction
All transactions are governed by the laws of India. Any dispute shall fall under the exclusive jurisdiction of courts in Kolkata, West Bengal.

16. Acceptance
Placement of PO or written confirmation by the Buyer constitutes full acceptance of all the above terms.
